SOUTH CAROLINA Statute: SC Code Ann 44-63-150 (2003)

South Carolina will not issue a new birth certificate. They will send a card to be attached to the old birth certificate, indicating change of name and sex.

They require an original court order for the name change and a letter from the SRS surgeon. The fee is $39.00.

ADMINISTRATIVE AUTHORITY:
From: Jo Ann Gooding – "Legal Changes" is our authority to correct birth certificates relative to name and gender upon receipt of a court order based on gender reassignment surgery. Please see section wording; Section 37-Legal Changes:
  1. upon receipt of certified copy of a court order changing the birth record of a person born in this state and upon request of such person or his/her person or guardian, or legal representative, the State Registrar shall record the changes by:
    1. completion of a special form for attachment to the order record. Such form shall include the original information as it appears on the original certificate, the information as changed by the court order, identification of the court which issued the order and the date of the order and sufficient information about the registrant to link the special form to the original record. If amendments are to be made to the record in addition to the changes provided for by the court order, the form should include the original information as it appears on the original certificate, correct information as it should appear, and an abstract of the documentation used to support such amendments. When a copy of the original record is issued, a copy of the form must be attached; or:
    2. Inserting the new name on the face of the existing certificate when the change is ordered within the first year after birth, or:
    3. Preparing a new certificate omitting information concerning the father and making no reference to the original entry for this item when the court determines illegitimacy, or:
    4. Preparing a new certificate showing the information ordered by the court when the State Registrar deems that the nature of the amendment so requires.
  2. certificates amended by Section 37:
    1. Section 37 (a) (2) and Section 37 (a) (4) shall be marked “amended by court order”.
